Bank Julius Baer Case Essay

Before the arrival and leadership of Stuart Adam (â€Å"Adam†), Bank Julius Baer, North America (â€Å"BJB-NA† or the â€Å"Company†), the largest independently-owned European private bank in the United States, faced financial difficulties. By mid-2001, a worldwide market downturn caused a significant decline in Julius Baer Group’s (â€Å"JB† or the â€Å"Parent†) performance. In 2001, JB’s stock price was down by over 40% while the Parent experienced a 39% decline in net profits, 9% increase in operating expenses and an increase of 14% in employee headcount. BJB-NA, the â€Å"crown jewel† of JB, was barely profitable but no one inside the Company knew its true financial condition. JB had always been led by a member of the Baer family until January 2001. Despite significant family ties at JB, BJB-NA did not have a strong leader to drive the company. There was a lack of clear vision or direction for the Company. BJB-NA did not focus on profitability as a measurement of success. The attitude around BJB-NA was more about â€Å"keeping the peace† than creating any conflict or hostility. Even with a passive work environment, employee morale was low. Employees tended to blame other parts of the Company for their problems. The competitive environment in the High Net Individual (â€Å"HNI†) private banking sector increased dramatically during the 1990’s. BJB-NA was a boutique private bank in a business where bulge bracket firms dominated the competitive landscape. As such, the key factors for success in the HNI market were now recognized as differentiation (not cost leadership), improved client relationship management, broad product range and strong client-responsiveness. BJB-NA strived to be a partner organization that differentiated itself from the competition by satisfying the needs of its clients. The existing organization structure consisted of BJB-NA organized into four regionally-based â€Å"teams. † Poor communication existed throughout the Company as the staff didn’t know what was going on and there was little cohesion among units. BJB-NA operated on a â€Å"need to know† basis. Team leaders were not responsible for their own budgets, as it was not known if their teams were profitable or not. To further support the lack of accountability at BJB-NA, the Company did not have a systematic performance valuation system and lacked a compensation system tied to customer growth and returns. Bonuses were virtually guaranteed and all bonus decisions were made by Bank’s top leadership. Most likely, there were employees who â€Å"flew under the radar† if they underperformed since the Company never laid anyone off. Adamà ¢â‚¬â„¢s Changes and Evaluation Adam arrived at BJB-NA and immediately laid out an action plan to turn around the Company. One of Adam’s best early moves was his selection of Denise Downey to head the Segmentation Study Team. Downey was well respected by the employees that she led and was able to thoroughly evaluate the organization and deliver results to the Company and Adam. Based on the Segmentation Study, Adam wanted BJB-NA to really stand-behind its promises to be a partner organization. He encouraged full transparency and a strong focus on measurable results and accountability. Specifically, he focused on the following three initiatives: Refocus the Company strategy: Adam emphasized that BJB-NA shift its focus to Europeans, Asians, Canadians and Latin Americas who live outside the U. S. who had U. S. based asset management needs. By targeting specific geographic and customer segments, it allowed the Company to specifically focus its strategy and resources rather than spread itself too thin to satisfy a larger, diverse customer base. In addition, he asked some longstanding personal clients who were not profitable to close their accounts. Not only did this change the Company’s customer focus, but also, it signaled to employees that Adam had confidence and high expectations for BJB-NA. Establish new performance expectations: Adam developed productivity assumptions that would hold employees more accountable. He established measurable criteria related to book value, relationships and accounts. Previously, Company employees truly did not know their clients. As a result, it was difficult for management to identify top and low performers. Adam’s established criteria that pushed Relationship Managers past their comfort zone. Before Adam took the helm at BJB-NA, almost everyone received bonuses regardless of their performance. Tying a bonus program with a structure performance evaluation system incentivizes those who bring success and growth potential to the Company. Modify the organization structure: Adam slightly altered the structure of BJB-NA by having a client-segment focus within existing geographic areas. As such, the decision making processes were now decentralized to each of the regional teams. Previously, the advisory and product services departments worked with all regions. After Adam took charge, he assigned advisory teams to each of the different regions to further strengthen customer relationships. Recommendations BJB-NA recognizes that its future success hinges on one important factor: its clients. Our consulting firm wants the Company to further expand and impact its clients beyond what Adam has already planned. Our approach is a client-centric strategy that focuses on two key initiatives: (1) Aggressively recruiting top talent to enhance client acquisition and performance (2) Overhauling the compensation scheme and performance measures. Each initiative, accompanied by supporting tactics, will align to elevate the client experience, resulting in deepening wallet share, increasing warm referrals, and building the BJB-NA brand in supreme customer service. I. Recruiting the Right Talent. Recruiting the right people to manage and advise BJB-NA’s clients will be critical to sustaining long-term growth and increasing assets-under-management. Recruiting will align with the Company’s geographic approach to segmentation by adopting three tactics:  · Local talent recruitment – a successful private banker needs an outgoing, service-orientated personality, and the ability to connect with potential and existing clients. In connecting with clients, it becomes mandatory that future private bankers will be recruited from local regions. This strategy will generate bankers who know the local customs and cultures, speak the language, and are involved in the community. As a result, it creates comfort and familiarity for potential clients.  · Recruit from bulge bracket private banks –Company acquisition is not a feasible option at this time. However, employee/talent acquisition is an even better method to help improve the Company. Bulge bracket private banks are typically a part of much larger conglomerates, often weighed down high-level corporate strategies and â€Å"red tape. To attract bulge bracket private bankers, BJB-NA should promote an entrepreneurial environment that offers autonomy and flexibility while still offering resources found at larger firms. Recruit from ultra-boutique private banks – BJB-NA should actively target private bankers from smaller, boutique firms that have larger books, but have a need for a more global reach. Private bank clients are becoming more global, and with that, have a specific need for banks that have an international presence. BJB-NA provides a solution with offices in Asia, Western Europe, Eastern Europe, and the United States. At the same time, by aggressively recruiting boutique bankers, BJB-NA will be able to expand its presence by acquiring the books of these bankers who may have a strong presence in untapped markets within the targeted regions. II. Restructuring Compensation and Performance Measures BJB-NA should introduce a compensation scheme that will not only be more beneficial for keeping clients’ interests first, but also offer higher potential incentives for the Company’s bankers. First and foremost, bankers will be paid based on client portfolio performance. No one will be paid on the basis of commission. While this tactic may seem counter-intuitive in the short-term, especially in the midst of a struggling economy, it acknowledges BJB-NA’s long-term commitment to its clients. Other positive externalities resulting from a new compenstation structure include: differentiation from competition, potential referrals from clients, and attention to BCB-NA’s innovative thinking. In short, BJB-NA’s message is: â€Å"We make money only when our clients make money†. Second, standard annual bonuses will be foregone. Employees would be accountable for their performance and compensated accordingly. BJB-NA will incentivize bankers by the value they add to their clients and related portfolio performances. This compensation structure ultimately rewards bankers who take of their clients and strive to grow their assets under management. Finally, BJB-NA should revise the position title of its company leaders. To accurately reflect the duties of the position, the title †Team Leader† should be changed to â€Å"Managing Director (MD)†. MD’s would have full P&L and people-management responsibilities of his/her respective branch. In addition, MD’s could receive an additional bonus based on the branch’s bottom-line performance. This change will push decision-making down to MD level, promoting entrepreneurship and autonomy. III. Management and Leadership Since Adam decided to resign from his position as the leader of BJB-NA, it is vital for the Board of Directors to select a successor that will be able to implement the changes initiated under Adam’s tenure. As discussed, BJB-NA needs to aggressively put its clients before anything else in its business. The new successor should be an experienced professional who deeply understands the Company’s clients and industry. Taking these requirements into consideration, we recommend that the Board of Directors pick Adam’s successor from a list of internal candidates only. Currently, the firm is in a state of fragility. Employees are stressed and morale is low. With the initial round of layoffs that included six people, any move will be highly scrutinized and may have a long-term impact on the organization. Employees were already caught off guard with Adam’s resignation, especially after he led the restructuring efforts at an off-site meeting that seemed to build positive momentum. To replace Adam’s with an external candidate may put the Company in a state of flux. An external candidate would not have attended the restructuring meetings and participated in the Segmentation Study. He/she may have different views of how the organization should be changed. In addition, the HNI private banking industry is built around relationships. To bring on a new leader who hasn’t built a strong rapport with a majority of the Company’s clients would make the leadership transition a difficult process. One potential internal candidate BJB-NA should consider is Denise Downey. Downey is currently the Head of U. S. Domestic Clients, but more importantly she led the Segmentation Study that evaluated areas of improvement needed at BJB-NA. Employees viewed Downey as a strong, effective leader who always delivers results. As a sign of trust, Adam gave Downey significant autonomy during her time leading the study. Elevating Downey to the C-suite level would be a fairly seamless transition. Downey has significant experience understanding the clientele of BJB-NA since she already leads U. S. client group. With all of the â€Å"client-focused† changes that need to be implemented by Adam, Downey will be best candidate to effectively communicate the steps needed during the transition period. For example, during her time as the Segmentation Study leader, Downey took the initiative to send updates to the entire bank. Alternate Approaches Deviating from a client-centric strategic plan could negatively impact BCB-NA’s future success. Nonetheless, two other alternate approaches were considered. The first approach considered a compensation system where bankers would be paid variable commissions based on fee-based transactions. The variable in commissions would depend on the type of investment vehicles clients would invest in. This viable approach guarantees cash flows from transactions with no dramatic culture change. However, after careful consideration, this alternative was rejected since bankers would be incentivized more by selling a diversity of investment vehicles to clients rather than working for clients’ best interests. The second approach considered but rejected involved an overhaul of the organization structure. After the Segmentation findings, Adam seemed adamant about moving away from the geographic-focused organizational structure of the Company. As such, an alternative approach considered was to eliminate geographic departments and implement an organizational structure focused on client-type. One of the key success factors for companies in the private banking industry is to customize services based on the needs of customers. A BJB-NA client-focused structure based on client characteristics (such as wealth, age, income level) may be more advantageous, especially with raised expectations now required by Adam on bankers’ book of clients. Additionally, within a geographic organization, conflict may occur between local regional management and the executives at corporate. As such, this may hurt the opportunity for knowledge sharing and collaboration, values emphasized by the Baer family. However, as much as a client-focused structure might have its advantages, a geographic organizational structure still is the most effective for BJB-NA. Communication is much more personal in geographic organizational structures. Instead of calling or videoconferencing with olleagues across the globe, it forces employees to sit next to each other to form collaborative teams, values preached by the Baer family. In addition, it allows employees to understand each other’s personalities and work styles. Besides the human capital element, geographic work teams allow BJB-NA to hire leaders familiar with the local business environment, something vital for the relationship-focused private banking industry. Not only will employees understand the client better but the clients will be more comfortable around employees who share similar interests and culture.

Comparing and Contrast curriculum models In early childhood education, we model our programs after highly respected models such as, Montessori, High Scope, and Reggie Emilia, Creative Curriculum, etc. We all have our own approaches to education. In the following paragraphs I will summarize two curriculum models, compare and contrast two of the curriculum models and compare the one that best matches my own educational philosophy.High/Scope curriculum is based on Piaget's concept that children are asctive learners who construct their knowledge base through playing and experimenting ith hands-on materials (Segal, Bardige, Wolka, ; Leinfelder, 2006). This curriculum framework describes educational ideas and strategies but does not rely on a specific set of materials.The five basic principles that form the framework of the Hlgh/Scope Curriculum are active learning, supportive adult-child interactions, a materials-rich learning environment, a consistent daily routine, and ongoing child ass essment. The Hlgh/Scope educational programming Includes the following elements: a core curriculum that includes specific elements but encourages following children's nterests, a three-phase â€Å"plan-do-review† learning cycle, and assessment tools and strategies (Follarl, 2007).

It will come about in one of two ways: Either we decide to manage our own numbers, to avoid a collision of every line on civilization’s graph – or nature will do it for us, in the form of famines, thirst, climate chaos, crashing ecosystems, opportunistic disease and wars over dwindling resources that finally cut us down to size† – Alan Weisman A striking quote, if I may say so myself. It embraces and implies in one whole thought the problem of a majority of the countries all over the world are currently facing, the same problem our country has; overpopulation. First and foremost, what exactly does the term â€Å"overpopulation† mean? What does it refer to? Can it be stereotyped as something bad or is it actually a good thing? Arbitrarily speaking, like all other things, overpopulation has its pros and cons. According to the Merriam-webster dictionary overpopulation is â€Å"the condition of having a population so dense as to cause environmental deterioration, an impaired quality of life or a population crash† whereas according to Wikipedia, â€Å"overpopulation occurs when a population of species exceeds the carrying capacity of its ecological niche. It is a function of the number of individuals compared to the relevant resources such as, the water and essential nutrients they need to survive which can result from an increase in births, a decline in mortality rates, an increase in immigration or an unsustainable biome and depletion of resources. † Note that the prefix over applied to other word case scenarios indicate more than desirable, this may also be applied to the word overpopulation. According to Casey B. Mulligan’s article, â€Å"The More the Merrier: Population Growth Promotes Innovation† she focuses on the conclusion that population growth should not be controlled in order to combat global warming, and other world problems since other economists ignore the significant economic benefits of large populations thus implicating that overpopulation is not a burden for a country but more or less an advantage. She justifies her point by quoting the director general of UNICEF, â€Å"Family planning could bring more benefits to more people at less cost than any other single technology now available to the human race† which strongly accentuates her belief that the larger the population, the more viable advantages it brings. One of the benefits of reduced population, it is claimed, is reduced carbon emissions and therefore mitigation of climate change. This statement takes technology for granted, yet technology itself depends on population. The more people on earth, the greater the chance that one of them has an idea of how to improve alternative energy or how to mitigate the climate effects of carbon emissions. It takes only one person to have an idea that can benefit many which focuses on appeal for innovation but this may only happen when the people in said community are encouraged to become responsible and productive. Many scientists agree that the human population is quickly reaching the point at which the planet will be unable to sustain it. This growth has placed a huge strain on the planets finite resources and done serious economic damage to nations all over the world, but some people, aside from Casey B. Mulligan, believe that there are a few advantages to having an ever-growing worldwide population. Among the other advantages or benefits of overpopulation is (1) increased labour forces resulting to increase in produced goods and services thus providing an economic boost, (2) more minds or ideas that will generate greater technologies in the future and (3) increased military might. But, are these advantages enough to encourage overpopulation to just continue as it is now? There are a lot of questions and controversies linked to the fast growing issues about the population with both the Catholic Church and our government officials going on about the pros and cons we now face because of ever growing population. Recently, news about the RH Bill created a public uproar but what exactly is the RH Bill all about? The Reproductive Health bill, popularly known as the RH bill, aims to guarantee universal access to methods and information on birth control and maternal care with a goal to help people prepare and widen up each and every individual’s mind setting about our society in all its modernized glory. There has been a debate on its proposal that we, as taxpayers, along with various private sectors will fund and undertake widespread distribution of family planning devices such as birth control pills and IUDs which the Catholic Church strongly opposes against usage since it goes against the unwritten law of life. Hence, usage of these controversial pills is considered an immoral crime. Whereas, the Government reasons that the Philippines is in dire need of this bill since overpopulation is unhealthy for a country like ours. Overpopulation manifests growth. Growth may either be good or bad but for a majority of the public, growth in terms of the human population, is bad. People have been brainwashed into believing that all growth, unless it pertains to cancer, is unquestionably a good thing. But let’s really dwell and think about this cautiously. Would we want our population to grow until people standing in a mall end up shoulder to shoulder? Would you want that? I wouldn’t want that! That itself is an indication that we’ve recognized that the population growth must stop at some point, and not just slow down, either. Though most scientists and researchers argue that global warming is the big thing to worry about, they have completely neglected the root cause. At this point in time, it doesn’t even matter if humans are responsible for global warming even if we are so clearly the cause of the events unfolding right now. Too many mouths to feed and less natural resources on hand can have a devastating effect on the economy. Our country faces the problem of overpopulation and we are subject to disadvantages such as (1) more mouths to feed, (2) lowered standard of living, (3) increased problems pertaining to poverty, (4) overcrowded public areas, (5) sickness and spreading of diseases, (6) insufficient natural resources to provide adequate goods and services, (7) inadequate facilities such as housing, medical etc. Problem of starvation and malnourished population, (9) education facilities may not meet the requirements of the entire population, (10) unemployment, (11) higher crime rate due to unequal distribution of wealth and insufficient financial resources, (12) environmental pollution, trees are felled to make space for housing facilities, (13) agricultural production is insufficient to meet the requirements of the entire population, which results in higher prices, (14) money is diverted to ensure that the population is fed, rather than carrying out fundamental research, (15) lower life expectancy, (16) large number of people live in unhygienic conditions, (18) heightened birth rate and so much more. The list goes on! All the world leaders are concerned about how to feed, clothe, and supply water and energy to the growing multitudes but all these efforts will prove futile if world population continues to grow. We live on a finite planet. Growth will simply overwhelm the attempted remedies. The effects have been stated but what exactly are the causes of overpopulation? Some of the causes of overpopulation are as follows: Decline in death rate: the fall in death rates that is also known as decline in mortality rate is one of the fundamental causes of overpopulation. Owing to the advancements in medicine, man has found cures to the previously fatal diseases. This has resulted in an increase in population. Rise in birth rate: thanks to the new discoveries in nutritional science, we have been able to bring in increase in the fertility rates of human beings. Medicines of today can boost the reproductive rate in human beings. There are medicines and treatments which help in terms of conception. Thus, science in one way or another has led to an increase in birth rate. Migration: Immigration is a problem in some parts of the world. If the inhabitants of various countries migrate to a particular part of the world and settle over there, the area is bound to suffer from the ill effects of overpopulation. If the rates of emigration from a certain nation do not match the rates of immigration to that country, overpopulation is therefore present creating an imbalance in the density of the population. Lack of education: illiteracy is another important cause of overpopulation. Those lacking education fail to understand the need to prevent excessive growth of population. They are unable to understand the harmful effects that overpopulation emits. They are unaware of the ways to control population. Lack of family planning is commonly seen in the illiterate areas of the world which constitutes as a major factor leading to overpopulation. So, does our planet benefit from overpopulation or does it cause more harm than it does good? Once again, we are left to contemplate and ponder whether overpopulation can be considered a plausible advantage or a disadvantage. Taking into careful consideration the growth of the population in the Philippines which is expected to reach a hundred million this year putting a strain on the country’s resources, the Commission on Population (Pop-Com) said. â€Å"Definitely in the third or fourth quarter of this year, we will be more than 100 million,† Pop-Com executive director Juan Antonio Perez III told The STAR in a recent interview. In 2014, the National Statistical Coordination Board estimated the country’s population to be around 97. 35 million. Studies show that over a period of time, the increase of population slowly increases but in the span of 30 years, we could probably hit over a billion in number. And if that isn’t alarming, I don’t know what is! Viewing the issue of increasing population optimistically, one may say that overpopulation means the increase in human resources. This may be true but we cannot ignore the fact that the increase in the number of producers implies an increase in the number of consumers. Greater number of people requires a greater number of resources which our nation is not capable of providing at the very moment. The Philippines as slow progressing country must acknowledge that the Earth has finite resources. Our current population increases and economic growth mentality bear all the hallmarks of a country still locked into colonial thinking. Population and personal consumption are two sides of the same coin. The logical conclusion is that we can’t keep consuming these resources indefinitely, either through increasing per capita consumption or the number of us consuming. And yet, how we balance two options remains a subject of contention. This is where consumption and sustainability play a role. The population issue is fraught with moral positions, confusion and unexpected connections. We cannot talk about population growth without also discussing decline; or immigration, without climate and business; or contraception, without faith and medical technology. It is the mother of cross-cutting issues – at the intersection of economics, environment, gender roles, culture, politics and religion. The population question is about the possibility and necessity of balancing the needs of nature and human civilization and this must take place as soon as possible before what we dread happens, depletion and insufficiency of our environmental resources. The worst enemy of life is too much life, the excess of human life. But think again will life kill life or we just need to think how life can help other life even in the edge of overpopulation. You cannot stop overpopulation you need to maintain it or accept it make it an advantage even everybody thinks it is a disadvantage, nobody really know what overpopulation can bring let just help each other to make this overpopulation an advantage.

Sexual harassment in the work place Sexual Harassment in the Work Place The Clarence Thomas Supreme Court case confirmation hearings in 1991 were the first to bring the issue of sexual harassment into increased standing. Anita Hill, a former employee of Thomas, alleged that he had sexually harassed her while she was working under his supervision. Although the allegations where never sustained, the hearing made many people more aware of how often employees are sexually harassed in the work place. This, combined with other events lead to a tremendous increase in the number of sexual harassment complaints bring filed with the Equal Employment Opportunity Commission (Chapter 3, 123). In addition to the early allegations, there have been more recent incidents that have brought more attention to sexual harassment in the workplace. One major incident took place after President Clinton took office and faced a sexual harassment lawsuit by Paula Corbin Jones. Jones alleged that Clinton sexual harassed her during a business trip in a Little Rock hotel room. This caused the number of sexual harassment complaints to jump in number, again, between 1993 and 1994. However, the number of cases filed has decreased substantially since 2000 (Chapter 3, 123). There are two specific legal definitions of sexual harassment that have been established in employment law. Quid Pro Quo Harassment; this is transferred into â€Å"something for something,† or â€Å"you do something for me and Ill do something for you† (Sexual Harassment, 2009). This happens when unwelcome sexual advances are expected in exchange for certain job benefits. An example of this would be an employee being offered a raise or a promotion if they go out on a date with the particular supervisor. This also happens when an employee makes a decision, or provides or withholds certain opportunities based on another employees submission to verbal, non verbal or physical conduct (Sexual Harassment, 2009). Quid pro quo harassment is just as unlawful whether the victim resists and suffers the threatened harm or submits to avoid the harm (Sexual Harassment, 2009). The Bundy v. Jackson case illustrates quid for quo sexual harassment. Bundy was a personnel clerk with District of Columbia Department of Corrections. She received repeated sexual propositions from Delbert Jackson, who was currently another employee when this happened. He later became the director of the agency. After this she began to receive propositions from two of her supervisors. She took the issue to their supervisor, Lawrence Swain, who dismissed her complaints; telling her that â€Å"any man in his right mind would want to rape you,† then proceeded to ask her to begin a sexual relationship with him (Chapter 3, 123). When Bundy was eligible for a promotion, she was passed over because of her â€Å"inadequate work performance,† although she had never been told that her work performance was unsatisfactory (Chapter 3, 123). The second definition is Hostile Environment Sexual Harassment. This happens when an employee is â€Å"subjected to comments of sexual nature, offensive sexual materials, or unwelcomed physical contact as a regular part of the work environment† (Chapter 3, 123). Normally if this were to happen once it would not be considered hostile environment harassment unless it is extremely outrageous conduct. Under this definition the courts look to see whether the conduct is both serious and frequent. Supervisors, managers, co-workers and even customers can create a hostile environment (Chapter 3, 123). These types of behaviors are also covered under Title VII because they treat individuals differently based on their sex. Also, although most harassment cases involve male on female harassment, any individual can be harassed. For example, male employees at Jenny Craig alleged that they were sexually harassed, and a federal jury found that a male employee had been sexually harassed by his male boss (Chapter 3, 123). In addition, Ron Clark Ford of Amarillo, Texas, recently agreed to pay 140,000 dollars to six male plaintiffs who alleged that they and others were subjected to a sexually hostile work environment and treated differently because of their gender by male managers (Chapter 3, 123). There are three critical issues when dealing with sexual harassment cases. First, the plaintiff cannot have â€Å"invited or incited† the advances (Chapter 3, 123). Most of the time the plaintiffs sexual history, whether she or he wear provocative clothing, and whether she or he engages in sexually explicit conversations are used to prove or disprove that the advance was unwelcome (Elements, 648). The second critical issue if that the harassment must have been severe enough to alter the â€Å"terms conditions and privileges of the employment† (Chapter 3, 123). Many courts have used the â€Å"reasonable woman† standard in determining the severity or pervasiveness of the harassment (Elements, 648). This consists of assessing whether a reasonable woman, faced with the same situation, would have reacted similarly. This recognizes that behavior that might be considered appropriate by a man may not be considered appropriate by a woman (Elements, 648). The third issue is that the courts must determine whether the organization is liable for the actions of it employees. To determine this, the courts normally examine two things. First, did the employer know about the harassment? Second, did the employer do anything to stop this behavior? Normally if the employer knew about the actions and didnt do anything to stop them then the court would find the employer guilty of not appropriately stopping the harassment (Elements, 648). The US Equal Employment Opportunity Commission (EEOC) describes sexual harassment as a â€Å"form of gender discrimination that is in violation of Title VII of the 1964 Civil Rights Act† (Abdulaziz, S. 2009). In 1998, the US Supreme Court made employers more liable for sexual harassment of their employees. Since then, the Society for Human Resource Management has reported that 62 percent of companies now offer sexual harassment prevention training programs, and 97 percent have a written sexual harassment policy (Abdulaziz, S. 2009). The number of cases filed with the EEOC has gradually decreased. In 1997, close to 16,000 charges were filled. Ten years later in 2007, only 12,510 were filed. â€Å"A telephone poll done by Louis Harris and Associates on 782 US workers revealed the following statistics: 31 percent of the female workers and only 7 percent of male workers reported they had been harassed at work, 62 percent of targets took no action, 100 percent of female workers were harassed by men, where as, 59 percent of men reported the harasser was a woman and 41 percent said the harasser was another man† (Elements, 648). Remedies for sexual harassment depend on the severity of sexual harassment complaints and findings of the investigator, as well as, the situation. When the person lost an employment opportunity the following could happen: hiring the person for the job or opportunity lost, providing the person with the opportunity with he or she missed to the extent possible, and providing financial compensation for the lost opportunity (Discrimination, 2009). If the person has lost wages the following could happen: all or part of the lost wages or salary would be compensated, lost pension or other benefits would be compensated, lost raises, overtime, shift bonuses, or higher rates of pay which should have been earned by promotion would be compensated, and any lost wages or benefits which can reasonably be linked to the act of sexual harassment would be compensated (Discrimination, 2009). Typically all expenses attributed to the enforcement of the persons rights can be compensated. Such expenses include: medical expenses, such as psychological care, travel expenses for attending physician, preparation of reports and costs of experts attendance at a trial, travel costs to attend a hearing, and wages and/or tips lost as a result of attending a hearing (Discrimination, 2009). Sexual harassment in a work place is any form of unwanted or unwelcomed behavior, or attention of a sexual nature that interferes with your ability to function at work. It is also, largely a form of gender discrimination that is covered under Title VII of the Civil Rights Act (Sexual Harassment, 2009).There are many cases that have resulted from sexual harassment and many different forms of remedies of such harassment takes place.

Comparing Cousin Kate and Seduction 'Cousin Kate' is set in the Victorian ages. It is about a young, beautiful working class maiden, who is taken away from her simple life by a lord, to a life of riches and luxuries. She lives a very shameful life because she lives with him and is sexually active with the lord before marriage. She even has a child with him. The maiden’s much more attractive cousin appears and the lord is intrigued by her. He leaves the maiden for Kate. The poem has a twist at the end; Cousin Kate is only interested in his money, but she cannot conceive any children for him, and the maiden already has a son of the lord’s and he will inherit his father’s wealth and land as his heir. A once poor cottage maiden will now live the life of luxury again but in the right way. In ‘I was a cottage maiden’, by using ‘I’, I can tell that the poem is in first person and is being told from the victim’s perspective; this also gives the reader access to the narrator’s thoughts and feelings. The poem is in past tense. ‘Cottage’ emphasises that she is from a working class background and ‘maiden’ suggests that she is a virgin, but being in past tense, the use of the word ‘was’ indicates that she is no more. ‘Hardened by the sun and air’ suggests that she is an outside worker; ‘hardened’ suggests that she is weather beaten. This could mean that her skin could be tanned from working in the hot sun. This also indicates that she is lower class. ‘Contented with my cottage mates’ suggests that she is informal and ordinary. This line also tells me that she is happy with her life. In the next line the narrator says ‘not mindful I was fair’ suggesting that she is unaware of her beauty. She then asks a rhetorical question: ‘why did the great find me out?’ The narrator uses this to show her regret over the lord. On the next line she says ‘and praises my flaxen hair’. This shows the lords pathetic attempts to impress the maiden; the words ‘flaxen hair’ suggest that her hair was stringy, dry and a pale yellow colour. The narrator repeats the rhetorical question ‘why did the great lord find me out?’ again to emphasise her regret and mis-judgement over the lord. ‘To fill my heart with care’ is ambiguous: the first is that she loves him; the second is that the lord brings the maiden worries. There are many reasons why there is a high deficit in the United States such as extensive spending. This is true because government spending is often economically destructive, regardless of how it is financed. There are many causes of the steady growth in U.S. trade deficits. There are many people are against the high deficits especially economists. â€Å"Economists define government intervention in the foreign exchange market as the buying or selling of foreign exchange for the purpose of manipulating the exchange rate. â€Å"(Case, pg. 398) Economists would agree that there are situations which lower levels of government spending would improve economic growth and other situations in which higher levels of government spending would be pleasing. If they still exist, it is because of the success gained over the years gone by after the settlers came to the New World. Settlers came to the New World in search of many things. They came in search of gold, they came for new lives, and they came for religious freedom. In England, during this time period, people were being judged, separated and persecuted on the basis of their religious beliefs. There were two groups of people that were unhappy with the Church. These groups came to be known as the Puritans and the Separatists. The Puritans are the people who are known to want to make changes within the Church of England. Then there were the Separatists, who were so disgusted with the Church of England that they just wanted out. They wanted to be recognized totally separate from it. One group, the Separatists. â€Å" In 1609, a group of about 125 Separatists moved from England to Holland (a part of the Netherlands) because the Dutch had a policy of religious tolerance.† They were able to practice religion how they wanted to, but they were uneasy about the thought of their children losing their English roots as time went on. So they came up with the idea of immigrating to the New World. Only about 30 wanted to voyage to Virginia, which was an unknown land to all. The Separatists sailed from Holland in 1620. This group was also known as the Pilgrims. The pilgrims are widely known for â€Å"The First Thanksgiving† as their offertory meal with the Native Americans. The Pilgrims goal was to establish a colony â€Å" as a distinct body by themselves.† And off they went for their voyage across sea, goals sighted for just north of Jamestown. Unfortunately, they were blown off course, so when they finally got a glimpse of land, it was Cape Cod. It was the separatists that put together the Mayflower Compact, which was a legal basis recognizing James I as their king and it state â€Å" that they would form a civil body politic, which would frame such just and equal laws for the good of all the people.† A solemn agreement was made to abide by the compact, and it was signed before anyone got off the ship. Only men signed the document because women of that time were not cons... ...st everyone who believe that in order to be recognized in life, you had to abide by the religious rules. Puritans especially believed that they could make changes in the Church to fit the needs of the members of the community. But what they did was just make the situation worse for the people who were already unhappy. The Separatists cut off all ties completely with the Church, because they were fed up with trying to deal with its strict rules and regulations.   Ã‚  Ã‚  Ã‚  Ã‚  It is because of people like Roger Williams, John Wheelwright, and Thomas Hooker that we have some of the religions that we have today. It is also the factor of the colonies being where they are today. Everything that was done in the past by people like them, has had a great effect on today’s society. It is because of the people from the past that gives the people the courage today to stand up for what they believe in. Without theses people, we would not have the great Martin Luther King, Jr., or other great people who made changes in history. We owe a great deal to their courage and their actions, because without them, we may not have some of the places, people, or ideas that we have today.
